What is DUI, exactly?
DUI stands for driving under the influence. What is the legal limit for a driver under the age of 21?
A driver who is under 21 years old may not operate a motor vehicle with a blood alcohol concentration of .02 or greater. This means that even trace amounts of alcohol in your breath or blood may result in serious penalties.
What penalties may I face if I’m convicted of DUI in Lee County, Florida?
A driver may face imprisonment in county jail or state prison as well as heavy fines, court fees, probation, community service, drug or alcohol counseling, and more.
How long will my driver’s license be suspended if I am convicted?
This will depend upon your blood alcohol concentration as well as whether this is your first, second, third or subsequent offense. For a first offense, license suspension may last from 180 days to 1 year. For a second offense within 5 years of the first offense, license suspension may last for a minimum of 5 years. A third offense within 10 years may result in license suspension that lasts for a minimum of 10 years.
How long do I have to schedule my DMV hearing?
You have only 10 days to schedule your DMV hearing, which is held to determine the suspension of your driver’s license. If you do not schedule your DMV hearing within 10 days of the date of your Lee County DUI arrest, your license will be suspended regardless of the outcome of your criminal case.
